The US District Court Judge refuses to punish Samsung for making the “untrue” statement
Lucy Koh, the US District Court Judge, has once again disappointed Apple, as she rejects the company’s motion against Samsung for providing the misleading information in the opening statement.
The motion was filed by Apple on Thursday. However, just after a few hours, the Judge denied the lawsuit, consequently disheartens Apple one more time.
The tension between the two companies arises when Samsung counsel said, “Apple admits that three of the five patent claims that it is suing on were not in that iPhone and have never been in any iPhone since. Apple doesn’t consider it valuable enough to even use.”
The statement infuriated Apple to make a lawsuit against Samsung, as the tech giant believes that the Korean company’s claim is totally “irrelevant, misleading and even untrue.” Apple believed that Samsung would be punished by the Judge. But the hope has been nipped in the bud, as the motion is being rejected.
According to Apple Balla, the Judge said, “Apple /4/present the invention story of [the ‘414, ‘172, and ‘959] patents, but /4/not contend that it practices the patents. Apple /4/not rebut any Samsung contention that Apple products constitute an acceptable non-infringing alternative to the ‘414, ‘172, or ‘959 Patents by contending that Apple practices an unasserted or asserted claim of the ‘414, ‘172, or ‘959 patents.”
The rejection has cost Apple a valuable opportunity for taking a huge advantage over Samsung, which could have led the Cupertino company to a victory over the Korean giant once again.
