The judge, Thokozile Masipa gave the verdict and a rush of voices started whispering in the courthouse. And while Masipa has yet to deliver the final decision regarding the case, for now Oscar Pistorius is in the clear.
Even if he is found to be charged with culpable homicide he won’t have to enter the cooler for this crime. The allegation of cold blooded murder is out of the question for now.
“Oscar Pistorius will not be found guilty of murdering Reeva Steenkamp,” according to Yahoo! Sports.
“The stunning development was revealed as Judge Thokozile Masipa read her summation of the evidence Thursday in front of a packed courthouse in Pretoria, South Africa, and a worldwide television audience.”
However, there is a chance that the prosecutors will appeal to a higher court. And then a murder charge /4/be in the works. Masipa has said that there was no evidence to point towards any preplanned murder having been committed by Oscar Pistorius.
The prosecution “failed to show requisite intention to kill the deceased, let alone premeditation,” said Masipa.
While the prosecution was trying to get Oscar convicted for having committed the most horrific homicide, Masipa said that according to the details, he was merely trying to protect himself and his girlfriend of an attack from an outsider and had unknowingly shot her.
While Masipa has not spared Oscar, calling him a weak personality behind the witness stand, she still said that it was not his fault and he was for all purposes innocent until proven guilty.
According to judge Masipa, the telephonic conversation records support Oscar’s point of view. Oscar and his girlfriend had no tiffs before the terrible event.
Furthermore, Oscar could not have concocted the whole story up. The details of his testimony were too similar each time he spoke them to have been made up on the spot.
The judge said that Oscar Pistorius’s recounting of what happened tallied with the reality of the situation and so he was probably telling the truth.
“To find otherwise would be tantamount to saying that the accused’s reaction after he realized that he shot the deceased was fake, that he was play acting merely to delude the onlookers at the time,” Masipa said.
When she delivered the preliminary verdict, Oscar broke down in court and started crying like a baby. It was clear that he was undergoing a great deal of stress.
The final decision of whether he will serve jail time or not is something which only the times which are to come will decide though.
