A sperm donor who lent his services to a lesbian couple has had a child conceived by one of them. Although he waived his rights as a legitimate parent of the child, according to a Kansas judge, he is to shell out child support. A loophole in Kansas law makes him the father of the child.

William Marotta had responded to a newspaper ad by two lesbians seeking sperm donation. After he was through and the child was born, a judge deemed him responsible for supporting the little baby. The reason given is that according to Kansas law, a certified medical doctor had to intervene in the insemination process. Since Marotta had not taken the aid of any general practitioner, his waiving of parental rights was null and void

However, Marotta and his lawyer insist on his ignorance and innocence in the matter. “I donated genetic material, and that was it” says William Marotta. The insemination was carried out by the lesbian couple within the confines of their home.

The case seems to be a complex one. After Marotta had donated his sperm he forgot about it. But later on the lesbian couple separated. The child had been born by them. Then one of them got sick and applied to the state for child support privileges. That’s when the whole matter came out in the open and Marotta was brought before the law.

His lawyer blames the state which is conservative and does not allow same-sex marriages to take place. But Marotta has no intention of being the father of a child by someone other than his wife. He says he had no idea that it would all end up like this. The judge meanwhile says he has to cough up $6000 in child support for the fateful decision he made once upon a time.
